论消费者合同中信息均衡的实现———以民法为视角

摘 要:消费者运用民法中的欺诈理论进行的事后救济方式,以及经营者被要求在一些具体合同领域履行告知义务的事先预防方式是当前在消费者合同中实现消费者与经营者信息均衡的主要路径,但这并不能从根本上解决二者之间信息不对称的事实。在继续完善事后救济路径的基础上,应继续增大国家力量的介入,使消费者知情权具有可诉性,逐步建立起以《消费者权益保护法》中经营者一般性告知义务为中心,由具体合同明示告知内容组成的经营者告知义务体系。

On Realization of Balance of Information in Consumers Contract ———From the Perspective of the Civil LawAbstract:Consumers should use the fraudulent theory and businessmen should be required to carry out theinformational obligation in some contracts, which is the main way to achieve the balance of information inconsumer contracts between the consumer and businessman, but that can not thoroughly solve the problemof the imbalance of information. There should be an improvement over the remedies after the damage, andat the same time, the consumer should be able to achieve the balance of information by means of suit. Greatefforts should be made to construct the system which should include the general informational obligation ofbusinessmen and the information in some particular contacts, and however, all of them need theintervention of the public power continually.
